Legal non conforming & Legal non complying defined in the context of zoning.

Legal real estate

Legal Non-Conforming Uses are uses that met all the requirements of the Zoning By-law (and any other requirements) when they were established but no longer comply because the zoning requirements have changed.

A legal non-complying use is defined as a building or structure erected prior to the date of the passing zoning by-law, on a lot having less than the minimum frontage or depth or area or having less than the minimum setback or side yard or rear yard or minimum useable open space required by the by-law.
